Terms and Conditions

By checking the box next to these Terms of Use and clicking the “Purchase” button, you as the student or client of any Mom Mode program or digital product, including but not limited to Ready for Baby and The Feeding Reset (hereinafter “Program”), whether purchased online or through special promotional pricing (hereinafter “you” or “Client”), agree that you are voluntarily entering into a legally binding Agreement with Mom Mode LLC (hereinafter “Mom Mode,” “we,” or “us”), inclusive of the following terms and conditions.
For good and valuable consideration, the receipt and sufficiency of which is acknowledged, Client is electing to purchase access to one or more Programs offered by Mom Mode. In exchange, Mom Mode agrees to provide the services and materials outlined in the applicable Program description and sales page at the time of purchase.
1. Program Outline
A.) Client understands and agrees that he/she is purchasing access to one or more digital educational programs created by Mom Mode, including but not limited to:
Ready for Baby – A multi-module digital program designed to help first-time moms prepare for baby, breastfeeding, newborn care, and postpartum recovery.
The Feeding Reset – A digital educational program designed to provide systems, guidance, and organizational tools related to breastfeeding, pumping, breastmilk storage, and common feeding challenges.
B.) Client acknowledges that he/she has reviewed the sales page and description of the Program being purchased and has conducted any additional research necessary to understand what is included and what is not included.
C.) Mom Mode reserves the right to remove any Client from Program access (including community spaces) without refund if Client is disruptive, defamatory, or negatively impacting the experience of others.
2. Non-Disclosure
A.) Client understands that Programs include proprietary systems, frameworks, written materials, videos, templates, guides, and intellectual property developed by Mom Mode.
B.) Client agrees not to copy, share, reproduce, distribute, sell, or repurpose any Program materials without express written consent from Mom Mode.
3. Testimonials
A.) Client understands and agrees that any and all commentary provided within the "Kajabi Communities" channels, a Mom Mode testimonial collection form, a conversation with Katie Caldwell, and/or on public social media profiles belonging to Mom Mode may be published and used as testimonials by Mom Mode. Client gives Mom Mode a non-exclusive license to use the copy as written inside all "Kajabi Communities" channels, social media profile, in an email, in a form, or in a transcript of a call, or otherwise, and repost on Mom Mode social media channels, in advertisements for digital education products, or other similar channels for the specific purpose of promoting and showcasing client results. Client understands that he/she will have no expectation of privacy within the Kajabi Communities platform, and that any comments made may be used by Mom Mode.
B.) The material, Client's name, and other identifying information will likely be published on Mom Mode's website, social media, or otherwise. No payment or additional services will be provided in return for Testimonial, and Client understands he or she is granting Mom Mode an unlimited, irrevocable license in perpetuity to use, publish, distribute, or repurpose any information provided to Mom Mode as part of a Testimonial.
4. Payment and Payment Plan
Pricing varies depending on the Program purchased.
Examples include, but are not limited to:
Ready for Baby (standard or promotional pricing as displayed at checkout)
The Feeding Reset (one-time payment, typically $37 unless otherwise noted)
A.) Client agrees to render payment in full or according to the payment plan selected at checkout.
B.) If a payment plan is selected (where available), Client agrees to automatic charges and remains responsible for full payment regardless of participation level.
C.) Failure to complete payments may result in loss of access without refund. Client remains responsible for any outstanding balance.
Special Promotional Pricing
From time to time, Mom Mode may offer limited-time promotional pricing for its programs, including but not limited to “Ready for Baby.” These promotional prices will be clearly stated on the corresponding sales page and/or checkout page and are valid only during the promotional period indicated.
Clients who enroll during a promotional period agree to the pricing and payment terms stated at the time of purchase, which supersede the standard pricing outlined in Section 4. All other terms and conditions remain in full effect.
A.) Client agrees to render payment via Credit Card on Mom Mode's sales and checkout page for products. Client understands that he/she/they/them is responsible for the full payment and agrees to pay the sum requested electronically via Mom Mode's website or a designated third party payment processor of Mom Mode's choosing, in full.
B.) If Client elects to purchase Ready for Baby or other product via one of the offered payment plans, Client agrees to abide by the rules and payments as explained on Mom Mode's sales page. Client understands and agrees that following the first payment, subsequent payments will be automatically deducted utilizing the same mode of payment that was used to make the initial payment. Should Client fail to make timely payments, or if additional payments are not able to be processed, Client understands: (1) the remainder of the Program may be forfeited if payment is not made within six days of the date it is due, and (2) Client will owe a $50 late fee if he/she has not made the appropriate payment after the six day grace period. Client's decision to cease use of Ready for Baby for any reason does not eliminate Client's responsibility to complete the payment plan as agreed upon. Payment in full is required regardless of use, happiness with product, or results.
D.) Client understands and agrees that his/her credit card used to make the initial payment in the payment plan will be automatically charged for each of the subsequent monthly payments thereafter, on or about the same date of the following month.
E.) Mom Mode reserves the right to cancel Client's access to Ready for Baby, The Feeding Reset, or other product should he/she fail to make additional payments in accordance with the payment plan as agreed upon. Should this occur, Client understands she/he is not entitled to a refund of funds already issues to Mom Mode in exchange for work completed thus far, and it is up to the sole discretion of Mom Mode whether Client is to have continued access to any materials made available to Client during the Program up until payments were missed.
F.) No refunds after revocation: In the event that access to the program is revoked due to missed payments, no refunds will be issued for payments already made. Additionally, the client will remain responsible for the remaining balance of the payment plan as agreed upon in the initial contract.
5. Refund Policy
A.) Mom Mode wholly believes in its product. It believes the methods work, but only if the Client is dedicated to the process. Nevertheless, Mom Mode offers a conditional 14-day money back guarantee if Client has completed the work to date, and does not believe the information completed is suitable for Client, or does not feel it works for Client. If Client is not completely satisfied with his/her purchase of Ready for Baby or The Feeding Reset within the first fourteen (14) days after program purchase date, Client may contact the support team at hello@itsmommode.com prior to 11:59 pm PST on the fourteenth day after product or program purchase date. In this email, Client must provide (1) the email address he/she used to purchase the product, and (2) copies of all completed work within the program or product, showing Client gave Program a good faith effort before deciding it was not right for him/her. Any and all requests for refunds will be decided by Mom Mode team and within Mom Mode's sole and exclusive discretion. If a refund is granted, Client can expect reimbursement thirty (30) days after cancellation of Program in the same manner in which payment was made. If a refund is not granted, Client understands he/she remains financially responsible for payment in full of Program, and as long as Client has received the full Ready for Baby course or other digital education product, Client has no further recourse regarding refunds. Client understands he/she will forfeit any and all access to Program and benefits if a refund is issued.
B.) Following this fourteen (14) day window, all sales will be considered final, and Mom Mode will not issue refunds for any reason. Please conduct any and all necessary research to determine if Ready for Baby, The Feeding Reset, or other digital education product is right for you prior to purchasing -- after the 14 day period, all purchases are final, and Client is responsible for the full payment of all program fees, whether or not Client completes Program. If Client purchased Program with a payment plan, all payments must be made regardless of participation level.
6. Voluntary Participation
A.) Client understands that participation in any Mom Mode Program is voluntary.
B.) Mom Mode provides educational content only. Client is solely responsible for his/her own decisions and implementation of Program content.
C.) Client agrees that Mom Mode is not responsible for any outcomes, health decisions, feeding outcomes, medical results, emotional responses, or other consequences arising from participation.
D.) CLIENT BEHAVIOR: While Client is allowed to express his/her opinion and honest reviews regarding Ready for Baby, The Feeding Reset, other digital education products and Mom Mode, should Client make any false or disparaging comments within "Kajabi Communities" channels, social media accounts, or any other community or platform where Mom Mode students communicate, or otherwise publicly speak negatively about Mom Mode, Katie Caldwell or any other member of Mom Mode, or Ready for Baby, Client may be removed from the community. Mom Mode places community and positivity at the forefront of their brand, and in order to preserve community standards and experience for other members, a customer who cannot abide by this may lose his/her access to the community. Client understands that any extensive negativity or similar disruption to the community in this way may result in removal from the Program and all relevant communities, with NO REFUND.
7. Educational & Medical Disclaimer
A.) Mom Mode Programs, including but not limited to Ready for Baby and The Feeding Reset, are provided for educational and informational purposes only.
B.) The content does not constitute medical advice and is not intended to diagnose, treat, cure, or prevent any medical condition.
C.) Client understands that breastfeeding, postpartum recovery, infant feeding, milk supply, latch concerns, and related topics may require individualized medical assessment. Client agrees to consult with qualified healthcare providers including OBs, midwives, pediatricians, or certified lactation professionals for medical concerns.
D.) Client agrees to hold Mom Mode harmless for any physical, emotional, or medical outcomes resulting from reliance on Program content.
E.) Client agrees that he/she does not have a cause of action, legal remedy, and is not entitled to a refund should he/she not achieve the results desired following completion of the program, as long as Mom Mode delivers the Program as described in Paragraph 1 above, or similar substitutes, upon additional agreement by Mom Mode and Client.
8. No Guarantees
Mom Mode does not guarantee:
Breastfeeding success
Milk supply outcomes
Specific postpartum experiences
Emotional results
Organizational results
Any specific personal outcome
Programs are delivered “as is” without warranties of any kind.
9. Guest Expert Material
Program may include various modules, trainings, bonuses, and other education and information from those other than Mom Mode, including but not limited to other industry leaders, experts, and professionals. All information, resources, training, education, modules, and other opinions provided by guest experts will be solely their own, based upon their education and experience, and are not necessarily a reflection of the opinions of Mom Mode. Client agrees to indemnify and hold Mom Mode harmless from any and all claims relating to material or information provided by a guest expert - any issues Client may have with a guest expert must be taken up with the guest expert directly.
10. Intellectual Property
All content remains the sole intellectual property of Mom Mode LLC.
A.) Client agrees and understands that Mom Mode has created numerous original, creative works in connection with the Program, and agrees that Mom Mode maintains all copyrights, licenses, and other intellectual property rights in all original or derivative content associated with or included in the Program, including but not limited to: videos, modules, documents, charts, emails, graphs, products, systems, processes, handouts, worksheets, checklists, templates, copy, and any other original work created by Mom Mode (hereinafter "Content"). Client agrees she may be granted a limited right to use selected materials in the course, but understands that the original proprietary rights remain with Mom Mode. Nothing in this Agreement shall constitute a transfer of ownership of any Intellectual Property from Mom Mode to Client, nor grant any license to use the information, other than that which is expressly provided throughout the course of the Program.
B.) Client agrees and understands he/she is not to copy, repost, alter, publish, sell, assist others in selling, manipulate, distribute, or in any way exploit any of the content or intellectual property provided by Mom Mode or in Ready for Baby or obtained through working with Mom Mode, without their express written consent. If such behavior is discovered or suspected, Mom Mode reserves the right to immediately end Client's participation in the Program without refund, as well as access to any program or materials Client may have purchased, without refund, and reserve the right to prosecute any actionable infringement or misuse to the full extent of the law.
C.) Licensee Rights: Mom Mode's Limited License to Client: Client understands that in purchasing the Program, she/he is gaining access to view all content and information available as part of the Program, as well as any additional information or content shared with him/her by Mom Mode as she sees fit. Client understands this means they have been granted a limited, revocable, non-transferable license to read and use the information provided for use in their business and life, as instructed or allowed by Mom Mode. As a "Licensee," Client understands and agrees that Client will not:
i. Copy, edit, distribute, duplicate or steal any information or any Content obtained through Program without written permission by Mom Mode;
ii. Post, distribute, copy, steal or otherwise use any portion of the Program or its content, or information obtained via other members in the group Program without written permission by Mom Mode, and understand that any such use may constitute infringement, which may give rise to a cause of action against Client.
iii. Claim any content created by Mom Mode as part of the Program or otherwise given to Client is his/her own, meaning he/she cannot claim any content created by Mom Mode was Client's work, and use in his/her business as his/her own.
iv. Share purchased materials, information, content with others who have not purchased them.
v. Client further acknowledges and understands that any such actions including but not limited to those outlined above will likely constitute infringement and/or theft of our work, and a violation of this Agreement and United States Federal laws.
11. Indemnification
Client agrees at all times to defend, fully indemnify and hold Mom Mode and any affiliates, agents, team members or other party associated with Mom Mode harmless from any causes of action, injury, illness, misunderstanding, damages, losses, costs, expenses incurred as a result of Client's use of Program, as well as any third-party claims of any kind (including attorney's fees) arising from his/her actions as a direct or indirect result of Client's participation in Program. Should Mom Mode be required to defend herself in any action directly or indirectly involving Client, or an action where we decide Client's participation or assistance would benefit Mom Mode's defense, Client agrees to participate and provide any evidence, documents, testimony, or other information deemed useful by Mom Mode, free of charge.
12. Program Access
A.) Digital programs are delivered electronically.
B.) “Lifetime access” means access to materials as they exist at the time of purchase, for as long as the product remains available on Mom Mode’s platform.
C.) Mom Mode reserves the right to update, modify, or discontinue Programs at its discretion.
13. Dispute Resolution
A.) If a dispute arises from or relates to this contract or the breach thereof, Client and Mom Mode agree to attempt to resolve directly through good-faith negotiations and discussions. (Client agrees that failure to see results is not a basis for a "dispute" and agrees he or she does not hold Mom Mode responsible for any specific results, or those results which have been achieved by other clients of Mom Mode.)
B.) If unable to reach a resolution informally, and if the dispute cannot be settled through direct discussions, Client and Mom Mode agree to endeavor first to settle the dispute by mediation administered by the American Arbitration Association under its Commercial Mediation Procedures before resorting to arbitration. The parties further agree that any unresolved controversy or claim arising out of or relating to this contract, or breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Client and Mom Mode agree to participate in the arbitration process in good faith and in a manner that will effectively and efficiently resolve the dispute at hand, including the exchange of any materials, documents, or information. The decision made by the arbitrator is to be final and binding on both parties, and is not to be appealed or otherwise set aside. It is to be enforceable in any court of proper jurisdiction as a judgment of law or decree.
14. Amendments
Mom Mode reserves the right to update these Terms at any time. Continued use of any Program constitutes acceptance of updated Terms.
